Welcome to getdm.in! These Terms and Conditions (“Terms”) govern the services provided by getdm.in (“Agency,” “we,” “our,” or “us”) to the client (“Client,” “you,” or “your”). By engaging our services, you agree to comply with and be bound by these Terms. Please read these Terms carefully before using our services.

1. Introduction

1.1 Overview

These Terms apply to all services provided by getdm.in, including but not limited to:

• Web & App Development
• Custom Website Development
• Digital Marketing
• Graphic Design
• Video Editing

1.2 Acceptance

By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please notify us via email. If we proceed with the delivery of services, any objections will not be entertained later.

1.3 Modification of Terms

getdm.in reserves the right to update or modify these Terms at any time. Notice of significant changes will be provided to the Client and updated on our website.

2. Services Provided

2.1 Web & App Development

• Website Design & Development (eCommerce, CMS, static/dynamic)
• Custom Web Applications
• Mobile App Development (iOS & Android)
• UI/UX Design & Optimization
• Website Analytics & Integrations

2.2 Digital Marketing

• Search Engine Optimization (SEO)
• Social Media Marketing (SMM) – Instagram and Facebook only
• Google Ads & Pay-Per-Click (PPC)
• Performance Analytics & Reporting

2.3 Graphic Design

• Logo & Branding
• Brochures, Banners, Posters, and Digital Assets
• UI Elements for Web & App

2.4 Video Editing

• Promotional Videos
• Product Demo Videos
• Social Media Reels & Ads

2.5 Custom Solutions
All additional or unique service requests will be quoted separately and added to the agreement upon mutual consent.

3. Agreement Duration

3.1 Commencement & Duration
The agreement begins on the date of signing and continues until project completion or termination by either party (see Section 10).

3.2 Extensions
Project scope or time extensions will be made via written amendment signed by both parties.

4. Fees and Payment Terms

4.1 Pricing

• Base Fee: Quoted based on project requirements.
• Additional Charges: Not included items like domain, hosting, paid plugins, stock media, third-party tools, etc. will be billed separately.

4.2 Payment Terms

• 100% advance is required unless otherwise agreed in writing.
• Payment details will be shared via invoice/email.

4.3 Customizations
Changes or additional requirements post-quotation will incur additional charges.

4.4 Late Payments

• A 2% monthly fee applies on overdue payments beyond 30 days.
• Services may be suspended after 60 days of non-payment.

4.5 No Refunds
Payments are non-refundable once project work has commenced.

5. Client Responsibilities

5.1 Content Provision
Client must provide all required assets (text, images, videos, etc.) and necessary approvals in a timely manner. Client is responsible for copyright permissions.

5.2 Review & Approval
Delays in feedback may affect the delivery timeline. Final approval is the Client’s responsibility.

5.3 Content Legality
Client must ensure provided content does not contain offensive, illegal, or copyrighted material. getdm.in is not liable for content-related legal issues.

6. Ownership of Work

6.1 Intellectual Property
Ownership of deliverables is transferred to the Client upon full payment, unless agreed otherwise.

6.2 Agency Portfolio Rights
getdm.in may showcase the completed work in its portfolio, unless the Client requests confidentiality in writing.

7. Confidentiality and Data Privacy

7.1 Confidential Information
All shared information is treated confidentially and will not be disclosed without consent.

7.2 Data Protection
Client data is safeguarded to the best of our ability and will not be sold or misused.

8. Social Media Management (SMM)

8.1 Platform Limitations
Our SMM services are limited to Instagram and Facebook. Other platforms (e.g., LinkedIn, YouTube) require separate arrangements.

8.2 Posting Responsibility
We do not post directly unless stated in the agreement. Client-posted content is their responsibility.

9. Sales and Lead Generation Disclaimer

9.1 No Sales Guarantees
We do not guarantee specific sales or lead outcomes from our digital marketing efforts.

9.2 Lead Follow-up
Client is responsible for following up with leads generated through our campaigns.

10. Termination

10.1 Termination by Either Party
Either party may terminate the agreement with 30 days’ notice in writing.

10.2 Termination for Non-Payment
Failure to pay may lead to suspension or cancellation of services.

10.3 Effect of Termination
All completed deliverables remain with the Client after payment; unfinished work access is revoked if dues are pending.

10.4 Termination for Content Violations
We reserve the right to terminate services immediately if the Client provides offensive or illegal content. Legal action may follow if necessary.

11. Limitation of Liability

11.1 No Indirect Liability
We are not liable for indirect losses including loss of data, business, or profits.

11.2 Content Loss
Client must maintain their own backups. We are not liable for data loss.

12. Governing Law and Dispute Resolution

12.1 Jurisdiction
These Terms are governed by the laws of Mumbai Jurisdiction.

12.2 Dispute Resolution
Disputes will first be resolved via negotiation or mediation. Unresolved issues will be addressed in courts under Mumbai Jurisdiction.

13. Amendments

These Terms may be modified only by written agreement signed by both parties. getdm.in may update these Terms with notice to the Client.

14. Acceptance

By engaging with getdm.in, the Client confirms they have read, understood, and agreed to these Terms and Conditions.
